Workers Denied Contracts by Their Employers: Arbitration Needed in Labor Law Reform

Workers join together and unionize to improve their wages, benefits, and working conditions. Yet a full year after voting to form a union, 52 percent of new unions still haven't been able to secure any improvements because their employers have used delay tactics to avoid signing a first contract.

It stands to reason that if a majority of workers vote to form a union in their workplace, then a union they shall have! Yet the sad reality is that all too often, employers do not respect the outcomes of union elections. The current labor law is grossly slanted in favor of employers and anti-union corporations who engage in unproductive "bad faith bargaining" or delay tactics to keep workers from getting a fair deal. The resistance to collective bargaining has only gotten worse in recent years. Even in cases when workers do successfully win their union election, over half of of new unions still have no contract one full year later after they are certified because companies refuse to negotiate in good faith. And two years later, 37 percent of workers still have no contract.

Congress needs to stand up for the workers who deserve the chance to gain fair first contracts. As a new ad by American Rights at Work points out, any legislation to reform our current labor system must include an arbitration option to push management to complete negotiations in a fair, timely manner---and stop anti-union corporations from gaming the system.

Stern: Unionized companies are a driving force in our economy

"Name a successful unionized company. Think. You're gonna go to break before you come up with one."

Today, SEIU International President Andy Stern made the following statement in response to comments by New York Times reporter Andrew Ross Sorkin and MSNBC's "Morning Joe" cast on the effectiveness of unionized companies.

"Unionized companies are a driving force in our economy, from Kaiser Permanente to Securitas. The bigger question this country is really asking right now is how do we define a successful company? Is it a company that turns a profit by driving down employee wages successful?  Is cutting off benefits or putting people out of work to improve the bottom line for shareholders a business model we as Americans want to embrace? Are we going to embrace the Wal-Mart model as the standard of success, or are we going to raise the bar and rebuild the middle class in this country?

"We think it's time to have a serious national discussion about what we want the future of our economy to look like--and the voices of women and men who work are critical to that conversation.  That's why we're supporting the Employee Free Choice Act, a bill to help create an economy in which companies succeed based on the quality of their services, not on their willingness to exploit or silence workers."

McDonald's Statement in Response to SEIU Actions at Restaurants Across the Country

From William Whitman Jr., Vice President, Communications, McDonald's USA:

The statement below should help provide further clarification regarding McDonald's recent communication with our franchisees about the Employee Free Choice Act. Please don't hesitate to contact me if you have any questions or comments.

McDonald's Statement:

"We regret our internal effort to keep our franchisees informed on all aspects regarding this legislation has been leaked to the press and mischaracterized as an anti-union campaign. This was not our intent.

McDonald's is not engaged in an anti-union campaign.

In fact, we pride ourselves on being the restaurant organization for all people -- especially during tough economic times like these.

As such, we try to not take sides in political issues, because we know our customers come from all walks of life, and represent diverse opinions and backgrounds.

Regarding this legislation, as a restaurant organization with 3,100 independent small businesses, we have a responsibility to inform and educate our system about legislation that could impact their business. This was the intent of the communication in question.

Unfortunately, the message was leaked to the media and excerpts were used to create the impression that McDonald's is engaged in anti-union activities. Again, this was not our intent.

We appreciate the opportunity to clarify McDonald's position -- and again, we regret any misrepresentation of the facts."
