Privacy Policy for Member Data

SEIU strongly believes in the importance of your privacy. This Privacy Policy describes how the Service Employees International Union (“SEIU”) collects, uses and discloses information with respect to your use of the website located at https://www.seiu.org , as well as other websites and applications that are owned and/or operated by the Service Employees International Union or its related entities or affiliates (collectively “SEIU”) that link to this Privacy Policy (collectively, the “Services”). By using or accessing the Services, you are accepting the practices described in this Privacy Policy.

Before you use or submit any information in connection with the Services, carefully review this Privacy Policy. By using the Services, you agree to the collection, use, and disclosure of your information as outlined below. The terms “you” or “user” refer to all individuals and entities accessing the Services for any reason. The terms “us” or “we” refer to SEIU.

How, When, and Why We Collect and Share Information

The information we collect from you and about you depends on how you use the Services and the information you provide to SEIU. We collect information in three main ways: (1) information you choose to provide to us; (2) information we collect automatically through technology when you use the Services; and (3) information we collect from others.

Information You Provide To Us

We collect information about our users when users choose to provide that information to us. For example, we collect information from users when they sign up to receive updates from us via autodialer, email or text, when they order SEIU merchandise online, or when they donate to the Committee on Political Education (“COPE”).

We may also collect username and passwords when users create accounts to use some of our Services. The kinds of information we collect may include your name, your email address, number, your date of birth, and the state where you work. We collect information when users register and/or apply to become an associate member of SEIU or to permit SEIU to collect money on their behalf. Your membership, association and any payment terms are covered by the specific terms applicable to those organizations and which have been provided to you by those organizations or payment systems. If you decide to register, we use a persistent cookie that stores certain information to make it easier for you to login when you come back to the Services. Certain information such as a user specific authentication token with a set expiration date may be stored in that cookie.

We may also collect your social media handles, your preferred language, and any other information you provide to us in connection with your use of the Services. Sometimes you may provide the information to a trusted third party on our behalf instead of directly to us. In such circumstances, the third party’s privacy policy and terms apply as to how it collects and processes the information you provide.

From time to time, we may conduct polls, surveys or seek to collect information via Every Action (or similar successor entities we may contract with), such as stories or quotes or other responses. Information collected through our polls, surveys, Every Action and/or questionnaires is generally used in the aggregate and we usually request permission to use your individual responses for a particular purpose. However, if you choose to submit information or documents to us, we reserve the right to use it on internal and external publications without or without your permission.

Information that Is Passively and Automatically Collected

You can view content on the Services without registering or providing any personal information. When you visitthe Services, we may automatically receive and record information from your device. This information allows us to understand how people are navigating and using our Services and how we can improve your experience based on the in formation we collect. The types of information we may collect include, by way of example only, your IP address, browser type, browser language, operating system, state or country from which you accessed the Services, software and hardware attributes (including device IDs), referring and exit pages and URLs, platform type, the number of clicks, files you download, pages viewed, the amount of time spent on particular pages, whether you subscribed to the RSS feed, the date and time you used the Services, error logs and other similar information. From your IP address, we may be able to infer your general location (e.g., city and state or postal code).

We may use third-party analytics providers and technologies, such as cookies, web beacons, or scripts, to help us collect the data described above. We may use pixel tags and/or trackable links in HTML-based emails sent to our users to track which emails are opened and/or clicked on by recipients. We use the term “cookie” in the broad sense to include all similar techniques and technologies. A cookie is a small text file that is placed on your device when you visit a website that stores certain information about your website usage. For example, cookies enable us to recognize your device; store your preferences and settings; enhance your user experience by delivering content specific to your interests; perform searches and analytics; and assist with security administrative functions.

You can change your settings to notify you when a cookie is being set or updated, or to block cookies altogether. If you disable cookies, some functionality of the Services may be impaired.

Information We Collect from Others

We may receive additional information about you from third parties and other sources, such as from public records, marketers, researchers, analysts, social media networks, data aggregators, and other organizations. We may combine this information with information we collect directly from you to derive your possible interests and to provide a more relevant experience for you and to improve the Services.

Furthermore, if you choose to provide us with access to certain personal information stored by third parties such as social media sites (e.g., Facebook or Tiktok), then you must know that the information we receive varies by site and is controlled by that site. By associating an account managed by a third party with usage of the Services you are authorizing SEIU to have access to this information, and you agree that SEIU may collect, store and use this information in accordance with this Privacy Policy.

When We Disclose Your Information

We may disclose your information to or with third parties under the following circumstances:

  • With Consent. We may disclose your information with your consent.

  • Affiliated Entities. We may disclose information to divisions and projects within SEIU, its related family of entities, as well as State and Local Affiliates.

  • To Service Providers. We may provide access to or disclose your information to select third parties that perform services for us to help us run SEIU. These may include, for example, entities that provide payment processing, marketing, help desk software and email services, advertising, security, research and analytics, and legal services.

  • With Collaborators and Other Select Entities. We may disclose your information to other entities with whom we may collaborate, such as the AFL-CIO or other organizations.

  • Protection of SEIU and Others. SEIU may disclose your information if required to do so by law or in a good faith belief that disclosure is permitted by this Privacy Policy or reasonably necessary or appropriate for any of the following reasons:

    • to comply with legal process;
    • to enforce our legal terms, including this Policy, as well as investigation of potential violations thereof;
    • to respond to your requests for assistance;
    • to respond to claims that our content violates the rights of third parties; and/or
    • to protect the rights, property, or personal safety of SEIU, its agents and affiliates, users, and the public. This includes exchanging information with other companies and organizations for fraud protection, spam/malware prevention, and similar purposes.
  • Organizational Transfers. If we participate in a merger, trusteeship, acquisition, bankruptcy, or other transfer or reorganization of assets (including in contemplation thereof, e.g., due diligence), we may disclose your information because user information collected through the Services may be among the transferred assets.
  • Aggregated Data. We may disclose aggregated and de-identified information.
  • If Legally Required. We may be required to disclose user information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. If we receive a subpoena requesting information about you and if you have provided us with your email address, we will attempt to notify you of the subpoena at the email address that you have provided, if it is lawful for SEIU to do so.

Access of Services via Mobile Device

SEIU may offer the ability for users to connect with the Services using a mobile device, either through a mobile application or via a mobile optimized website. The provisions of this Privacy Policy apply to all such mobile access and use of mobile devices. When you download or use our mobile applications, or access one of our mobile optimized sites, we may receive information about your location and your mobile device, including a unique identifier for your device. We may use this information to provide you with location-based services, such as advertising, search results, and other personalized content. Most mobile devices allow you to control or disable location services in the device's settings menu. If you have questions about how to disable your device's location services, we recommend you contact your mobile service carrier or the manufacturer of your particular device.

Information Security and Data Integrity

How we Protect Your Information

We are committed to protecting your information and SEIU has administrative, technical, and physical security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data. These safeguards vary based on the sensitivity of the information that we collect and store. However, we cannot and do not guarantee that these measures will prevent every unauthorized attempt to access, use, or disclose your information because, despite our efforts, no Internet and/or other electronic transmissions can be completely secure.

Retention of Your Information

We retain information for different lengths of time, depending on the purposes for which we collect and use the information. We may delete or de-identify information when it is no longer needed to fulfill these purposes, unless a longer retention period is required to comply with applicable laws. If there are technical or other reasons why we are unable to fully delete or de-identify your information, we will take reasonable measures to prevent further processing of your information.

Legal Basis for Processing Personal Data

The laws in some jurisdictions require that website operators tell you about the legal grounds they rely on to use or disclose your information. To the extent those laws apply, our legal grounds for processing your information are as follows:

  • Where use of your information is necessary to perform our obligations to you;

  • Where use of your information is necessary for our legitimate interests or the legitimate interests of others (for example, to provide security for our Services; to provide the services we provide through our Services; to defend our legal rights; to analyze the use of our Services; to improve our services);

  • Where we have a reason to process the information in accordance with applicable law;

  • Where we have your consent to engage in a particular type of processing activity.

Online Analytics

We may use third-party web analytics services (such as those of Google Analytics) in connection with the Services to collect and analyze the information discussed above, and to engage in auditing, research, or reporting. The information (including your IP address) collected by various analytics technologies described in the “Information that Is Passively and Automatically Collected” section will be disclosed to or collected directly by these service providers, who use the information to evaluate your use of the Services, including by noting the third-party website from which you arrive, analyzing usage trends, assisting with fraud prevention, and providing certain features to you. Online Advertising

We may allow select third-party advertising technology companies to place cookies or other tracking technologies on your device’s browser to collect information about you as discussed above. These third parties (for example, ad networks and ad servers) may use this information to serve relevant content and advertising to you as you browse the Internet, and to access their own cookies or other tracking technologies on your browser to assist in this activity. You may opt-out from Google Analytics for Display Advertising or the Google Display Network by using Google Ads Settings here: https://www.google.com/settings/ads.

If you are interested in more information about these online advertising activities, and how you can generally control cookies from being put on your device to deliver tailored advertising, you may visit the Network Advertising Initiative’s Consumer Opt-Out link at https://optout.networkadvertising.org or the Digital Advertising Alliance’s Consumer Opt-Out link at https://optout.aboutads.info, to opt-out of receiving tailored advertising from companies that participate in those programs. We do not control these opt-out links or whether any particular company chooses to participate in these opt-out programs. We are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms. Please note that if you use these mechanisms, you may still see advertising on our Services or across the Internet, but it will not be tailored to you based on your online behavior over time.

Privacy Rights

Individuals in some jurisdictions have certain legal rights with respect to their information. They can request, among other potential rights, that we (i) provide access to and/or a copy of certain information that we hold about them, (ii) update information that is incorrect, (iii) delete certain information that we hold about them, (iv) restrict the way we process and disclose certain information, and (v) revoke consent for the processing of their information.

The quickest way to stop receiving emails is to click the unsubscribe button on any emails that you receive from SEIU. The quickest way to unsubscribe from text messages is to text “stop” or “s” in response to any text messages you may receive from SEIU. You can also unsubscribe from emails and text messages by filling out this form.

To exercise these rights, please email us at privacy@seiu.org with the nature of your request. We will consider all requests and will provide a response within the time period set by applicable law. Please be aware that certain information may be exempt from such requests. In addition, we may ask that you provide us with information necessary for us to confirm your identity before responding to your request. While SEIU will endeavor to comply with all such requests, we do not control any third party that may have supplied or received information from SEIU and you will need to contact those third parties regarding your information.

Once we receive your request, we will delete, modify or correct your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us to: Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities, debug products to identify and repair errors that impair existing intended functionality, or to comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.) or other legal obligation.

Information Sales/Processing for Online Targeted Advertising

Under the laws in certain U.S. states, you may also have the right to opt out of our processing or disclosure of your information for online targeted advertising purposes. Note that certain state laws also allow you to opt out of the “sale” of your information to third parties in exchange for valuable consideration. We may use analytics and online advertising tools that result in the disclosure of your information to third parties and that are subject to this opt out right. You may opt-out from these activities as explained above in the sections above entitled “Online Analytics” and “Online Advertising.”

Children’s Privacy

The Services are intended for general audiences and are not directed at children. If we become aware that we have collected information without legally valid parental consent from children under an age where such consent is required under applicable law, we will take reasonable steps to delete it as soon as possible.

Third Party Sites

Our Website may also permit you to access non-SEIU sites. It is important to remember that, if you link to a non-SEIU site from our Website, that party's privacy policy and its user agreement apply to you, not this Privacy Policy. Please be aware that we are not responsible for the content or privacy practices of such other sites. Therefore, we encourage our users to be aware when they leave our Services and to learn about each third party's privacy policy before giving personal information to them.

Revisions to Privacy Policy

We will continue to review this Privacy Policy and we may make changes to the Policy from time to time. The date at the bottom of this page indicates the last time changes were made. You should check this page periodically for updates. If we make material changes to this Policy, we will provide you with notice as required by law. Your continued use of the Services will signify that you have read, understood, and accepted the terms of the updated Privacy Policy.

User Agreement

Please carefully review our User Agreement before you begin using the site.

These Terms and Conditions of Use (the “Terms and Conditions”) govern your use of the website located at https://www.seiu.org, as well as other websites and applications that are owned and/or operated by SEIU (“SEIU”) or its related entities or affiliates (collectively, the “Services”). These Terms and Conditions create a legal agreement directly between you and SEIU and explain the rules governing use of the Services. The terms “you” or “user” refer to all individuals and entities accessing the Services for any reason. The terms “us” or “we” refer to SEIU.

Your Acceptance

By accessing or using the Services, you acknowledge and agree that you have read, understand, and agree to be bound by these Terms and Conditions, as well our Privacy Policy . If you do not agree to these Terms and Conditions, please do not access or use the Services.

We have the right to update these Terms and Conditions from time to time upon posting revised policies. The updated Terms and Conditions take effect upon posting and will apply on a going-forward basis, unless otherwise noted. By continuing to use the Services after the posting of updated Terms and Conditions, you agree to the Terms and Conditions as amended.

Your registration information, as well as other personally identifiable information that you provide us about yourself on our sites, is subject to our Privacy Policy.

Eligibility to Use the Services

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this User Agreement, and to abide by and comply with this User Agreement. In any case, you affirm that you are over the age of 13, as the Services are not intended for children under 13.

Accounts

To access some of the Services, you may be required to create an account with a username and password. You agree to provide us with truthful, accurate, complete, and current information about yourself. You are responsible for ensuring that your login information remains confidential and secure. You are solely responsible for all activities that occur using your username and password. You understand that your account is personal to you, and that you are not allowed to allow a third party to access the Services using your login information without our express, written consent. You must notify us at info@seiu.org if you become aware of unauthorized access to or use of your account. You understand that SEIU will not be liable for any losses, damages, liabilities, expenses, costs or attorneys’ fees that you may incur because someone used your account, regardless of whether you had knowledge of the use, and regardless of whether you advised us of the use.

License to Use the Services

Subject to your compliance with these Terms and Conditions, we grant you a limited, non-exclusive, non-sublicenseable, non-transferable, and revocable license to access and use the Services solely for your internal, noncommercial use and only in complete compliance with these Terms and Conditions. SEIU may revoke this license at any time at our sole discretion.

General Use of the Services

SEIU hereby grants you permission to access and use the Services as set forth in these terms and conditions, as limited by the following:

Restrictions on Use

You agree not to use the Services to carry out, promote, or support

Any unlawful or fraudulent activities;

  • The impersonation of another person or entity, or the misrepresentation of an affiliation with a person or entity that does or is intended to mislead, confuse, or deceive others;

  • Activities that are criminal, defamatory, abusive, obscene, threatening, constitute hate speech, harassment, or stalking;

  • Making public the private or personal information of other people without their consent;

  • The sending of unsolicited communications, promotions, advertisements, or spam;

  • Publishing or linking to malicious content intended to damage or disrupt someone else’s browser or device; or

  • Promoting or advertising goods or services without SEIU’s express written consent.

  • Collection of personally identifiable information of others, including user names or email addresses, from the Services.

You also agree that you may not submit any User Submissions (as defined below) that:

  • Violates any applicable law, any third party’s intellectual property rights or their rights of privacy or publicity;

  • Is deceptive, fraudulent, abusive, illegal, obscene, pornographic, defamatory, threatening, constitutes hate speech, harassment, or stalking;

  • Contains any harmful materials, such as viruses, bots, or worms; or

  • Contains any information that you do not have the right to provide.

Furthermore, you agree not to:

  • Access, tamper with, or use non-public areas of the Services, our computer systems, or the technical delivery systems of our providers;

  • Probe, scan, or test the vulnerability of any system or network, or breach or circumvent any security or authentication measure;

  • Attempt to disrupt or overwhelm our infrastructure by intentionally imposing unreasonable requests or burdens on our resources;

  • Interfere with or disrupt the access of any user, host, or network, including, by way of example only, by sending a virus, overloading, flooding, spamming, or mailbombing the Services;

  • Use the Services or any SEIU Content on the Services in the service of or to train or facilitate any machine learning, intelligent retrieval, large language models, or any other utility or model broadly classified as “artificial intelligence;”

  • Not alter or modify any part of the Services.

This list of permissions and restrictions, along with the other terms discussed below, is not intended to be complete, but merely illustrative. We reserve the right in our sole and final judgment to determine whether conduct violates conduct requirements for the Services.

Your Breach of these Terms and Conditions

We have the right to terminate or suspend your access to or use of the Services upon your breach or intended breach of these Terms and Conditions, without liability and without notice to you. In addition, you acknowledge and agree that your breach of any provision of these Terms and Conditions would result in irreparable harm to SEIU for which money damages alone would be an inadequate remedy, and, therefore, you agree that we are entitled to injunctive relief to prevent or restrain any breach or threatened breach of these Terms and Conditions, in addition to any other remedies available at law or in equity.

Intellectual Property Rights

The content on the Services, including, without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like, ("Content") and the trademarks, service marks, and logos contained therein ("Marks"), are owned by or licensed to SEIU and subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. Content on the Services is provided to you AS IS for your information and noncommercial use only and the Content and the Marks may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever other than as authorized herein without the prior written consent of the respective owners. We reserve all rights not expressly granted in and to the Services, the Content, and the Marks. You agree not to engage in the use, copying, or distribution of any of the Content or the Marks other than as expressly permitted herein. You acknowledge that you do not acquire any ownership rights by downloading or printing copyrighted Content or by using the Marks. You agree not to circumvent, disable, or otherwise interfere with security related features of the Services or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Services or the Content therein.

User Submissions and Feedback

You are solely responsible for any content that you submit, display, post, or otherwise make available through the Services (“User Submissions”). When you submit User Submissions, you grant SEIU a worldwide, perpetual, irrevocable, royalty-free and fully paid-up, non-exclusive, sublicensable right and license to reproduce, distribute, publicly perform, publicly display, create derivative works of, and to otherwise use the User Submissions, in whole or in part, in any format or medium now known or hereinafter developed, for any purpose that is consistent with applicable law. We may, in our sole discretion, pre-screen User Submissions before they appear on the Services, or we may reject, move, edit, or delete any User Submissions for any reason or no reason, including, by way of example only, User Submissions that violate these Terms of Use.

If you choose to provide us with ideas or other feedback, whether in a User Submission or otherwise (“Feedback”), such Feedback will become SEIU’s sole and exclusive property, without any compensation to you. You hereby agree to and do irrevocably assign to us all right, title, and interest in and to all Feedback. You understand that SEIU has the right to use the Feedback on an unrestricted basis for any purpose whatsoever.

Digital Millennium Copyright Act

If you are a copyright owner or an agent thereof and believe that any SEIU Content or User Content infringes upon your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing SEIU's Copyright Agent with the following information in writing (see 17 U.S.C. 512(c)(3) for further detail):

    Identification of the copyrighted work claimed to have been infringed ● Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit SEIU to locate the material; ● A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; ● A statement that the information in the notification is accurate, and under penalty of perjury, that you are, or are authorized to act on behalf of, the owner of an exclusive right that is allegedly infringed; ● Your name, mailing address, telephone number, and e-mail address; and ● A physical or electronic signature of the owner of the exclusive right that is allegedly infringed, or that of the person authorized to act on behalf of the owner.

SEIU's designated Copyright Agent to receive notifications of claimed infringement can be reached at copyright@seiu.org. You acknowledge that if you fail to comply with all of the above requirements, your DMCA notice may not be valid.

Warranty Disclaimer

THE SERVICES ARE PROVIDED “AS IS.” YOU AGREE THAT YOUR USE OF THE SERVICES SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, SEIU AND ITS AFFILIATED ENTITIES AND EACH OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS, DISCLAIM ALL WARRANTIES, REPRESENTATIONS, CONDITIONS, AND GUARANTEES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES, REPRESENTATIONS, CONDITIONS, OR GUARANTEES OF QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES OR OF ANY SITES LINKED TO OR FROM THe SERVICES AND ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANYTHING POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES.

WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SERVICES OR ANY HYPERLINKED SERVICES OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND WE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES.

Limitation of Liability

IN NO EVENT SHALL SEIU OR ITS AFFILIATED ENTITIES OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANYTHING POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, OUR AGGREGATE LIABILITY RELATING TO THE SERVICES SHALL BE ONE HUNDRED U.S. DOLLARS ($100.00). THE FOREGOING LIMITATIONS OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

SEIU DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SERVICES OR ANY WEBSITE FEATURED OR LINKED TO THROUGH THE SERVICES, AND WE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. WE WILL NOT BE LIABLE FOR THE OFFENSIVE OR ILLEGAL CONDUCT OF ANY THIRD PARTY, INCLUDING OTHER USERS. If you are a California resident, you hereby waive California Civil Code §1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.” This release includes the criminal acts of others.

Exclusions and Limitations.

THE FOREGOING WARRANTY DISCLAIMERS AND LIMITATIONS OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND SHALL SURVIVE ANY TERMINATION OR EXPIRATION OF THESE TERMS AND CONDITIONS OR YOUR USE OF THE SERVICES. Note that some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages such as above. Accordingly, some of the above limitations may not apply to you. If you are a New Jersey resident, or a resident of another state that permits the exclusion of these warranties and liabilities, then the limitations above specifically do not apply to you.

Indemnity

You agree to defend, indemnify and hold harmless SEIU and its affiliated entities and each of their officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms and Conditions; (iii) your violation of any third-party right or any law, including without limitation any copyright, property, or privacy right; or (iv) any claim that any content you submit via the Services violates any third-party right or any law. WE RESERVE THE RIGHT, AT OUR EXPENSE, TO ASSUME THE EXCLUSIVE DEFENSE AND CONTROL OF SUCH DISPUTES, AND, IN ANY EVENT, YOU WILL COOPERATE WITH US IN ASSERTING ANY AVAILABLE DEFENSES. This defense and indemnification obligation will survive these Terms and Conditions and your use of the Services.

Third party Links and Content

You understand that when using the Services, you will be exposed to SEIU Content, User Content, and other third-party content from a variety of sources, and that SEIU makes no warranty about the accuracy, usefulness, safety, or intellectual property rights of or relating to such SEIU Content, User Content, or other third-party content. You further understand and acknowledge that you may be exposed to User Content that may be inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against SEIU with respect thereto.

The Services may contain links to third party websites that are not owned or controlled by SEIU. SEIU has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, we will not and cannot censor or edit the content of any third-party website. By using the Services, you expressly relieve us from any and all liability arising from your use of the Services, as well as any third-party website. We encourage you to be aware when you leave the Services and to read the terms and conditions and privacy policy of each other website that you visit.

Right to Modify Services

Through our sites, SEIU provides users with access to a rich array of educational resources, including personalized content. We hope you find our sites useful. We reserve the right to modify, suspend, or discontinue the Services, or any part of them, at any time, for any reason without prior notice to you. You agree that we shall not be liable for any such modification, suspension, or discontinuance.

Miscellaneous

This User Agreement shall be governed by the internal substantive laws of Washington, D.C., without respect to its conflict of laws principles. These Terms and Conditions, together with the Privacy Policy and any other legal notices published by us on the Services, shall constitute the entire agreement between you and SEIU concerning the Services and our services, and supersedes prior agreements, if any, between you and SEIU related to the Services. Any claim or dispute between you and SEIU that arises in whole or in part from the Services shall be decided exclusively by a court of competent jurisdiction located in Washington, D.C. If any provision of the Terms and Conditions are deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Terms and Conditions, which shall remain in full force and effect.

No waiver of any term of the Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term, and SEIU's failure to assert any right or provision under the Terms and Conditions shall not constitute a waiver of such right or provision.

The Terms and Conditions, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by SEIU without restriction. The Terms and Conditions and the rights and obligations created hereunder shall be binding upon and inure solely to the benefits of the parties hereto and their respective successors and assigns, and nothing in this Agreement, express or implied, is intended or should be construed to confer upon any other person any right, remedy or claim under or by virtue of this Agreement.

Except for residents of New Jersey, You and SEIU agree that any cause of action arising out of or related to the Services must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
